Tool purchases, renewal, cancellation and refunds

The tools listed on our pricing page are paid tools. A purchase gives you full use of the tools it covers, including their reports and exports. Purchases are sold by Arrochar Consulting Pty Ltd, trading as Arrochar Labs, in Australian dollars, and are charged to your card through Stripe. We do not see or store your card details.

A single tool is a one-off payment. It gives you 12 months of full use of that tool from the date you pay, and it does not renew. All access is an annual pass: it is charged once a year in advance and renews each year until you cancel it from your account page. When you cancel, the pass stays active until the end of the year you have paid for and is not charged again.

We do not refund a purchase once the tool has been unlocked, or part of a year, except where the Australian Consumer Law or another law that applies to you requires it. If you were charged in error, email us and we will put it right. We may change prices or what is included; a change never affects a period you have already paid for, and we will tell annual pass holders by email before a change applies to a renewal.

Using the tools: indicative results, at your own risk

What the tools are. The tools produce general, indicative, screening-level results from the information you enter, using simplified methods and published reference figures that are described on each tool. They run in your browser. We do not see, check or verify your inputs, and the results have not been reviewed against your circumstances.

Not professional advice. The tools, their results and their reports are not engineering, financial, legal, insurance, security, audit or other professional advice, and they are not a substitute for a site-specific study, an audit or the judgement of a suitably qualified person. They do not certify compliance with any standard or law.

Your responsibility. You use the tools and their results at your own risk. You are responsible for the accuracy of what you enter, for checking that a result is suitable for your purpose, and for every decision you or your organisation make using it, including decisions about spending, planning, property, safety, disclosure or compliance. If you pass a report to anyone else, you must pass on these limits with it.

No warranty. To the extent the law allows, the tools are provided as they are, and we give no warranty that they are accurate, complete, current, free of errors or fit for any particular purpose. Reference figures and frameworks change, and a tool may not reflect the latest version.

Limit of our liability. To the extent the law allows, Arrochar Consulting Pty Ltd, its directors, staff and suppliers are not liable for any loss or damage arising from your use of, or reliance on, the tools or their results, including indirect or consequential loss, loss of profit, revenue, opportunity or data, and loss arising from a decision made using a result. If we are liable despite this, our total liability for all claims connected with the tools is limited to the amount you paid us for the tools in the 12 months before the claim arose.

Your consumer rights. Nothing in these terms excludes, restricts or modifies a guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where such a guarantee applies and the law lets us limit our liability for breaching it, our liability is limited, at our option, to supplying the service again or paying the cost of having it supplied again.

Claims by others. If you use a result or a report in your dealings with someone else and they bring a claim against us because of that use, you agree to cover our reasonable loss and costs from that claim, except to the extent we caused it by our own negligence or breach of these terms.
